appproduce Platform Terms of Service

[Important Notice]

Welcome to the appproduce platform. These Terms of Service (hereinafter "this Agreement") are entered into between Yangzhou Huijian Network Security Information Technology Co., Ltd. (hereinafter "Huijian", "we", or "the Company"), which provides the service, and you (hereinafter "User" or "you"), and have the legal force of a contract.

Before using this service, please read all of this Agreement carefully, especially the clauses concerning exemption or limitation of liability, dispute resolution, and applicable law. If you have any questions about this Agreement, you may contact our customer service staff at any time.

Once you complete the registration process or log in to this system, you are deemed to have read and agreed to be bound by this Agreement and all ancillary rules (including but not limited to page prompts, operating procedures, and announcements). If you do not agree to any of the terms of this Agreement, please do not proceed.

I. General Principles and Statements

  1. Right to amend: To keep pace with changes in national laws and regulations, business development, and product iteration, Huijian reserves the right to amend this Agreement at any time. The amended Agreement will be announced through official channels. If you object to the changes, you should contact us with your feedback before they take effect; if you continue to use the service after they take effect, you are deemed to accept the amended Agreement.
  2. Capacity: You confirm that, when using this service, you have full capacity for civil conduct as provided by the laws of the People's Republic of China and can independently bear legal responsibility. If you lack such capacity, your guardian shall bear all resulting consequences in accordance with the law.
  3. Supplementary agreements: Given the complexity of internet services, matters not covered by this Agreement and rules that may arise in the future (including the appproduce Privacy Policy) constitute an inseparable part of this Agreement and have the same legal effect.

II. Service Content and Management

  1. Service definition: appproduce is an AI-driven application development platform operated by Yangzhou Huijian Network Security Information Technology Co., Ltd., designed to help users generate websites or applications. The specific scope of service is subject to the platform's feature descriptions and actual delivery.
  2. Fees: Some services on this platform may involve fees. The specific charging standards are subject to the order pages in the payment center, and refunds are governed by the "Refunds" clause of this Agreement. Completing payment indicates that you accept the relevant fee standards.
  3. Credits: Credits may be used only by the account that holds them, and only to purchase or consume services on the platform. Credits may not be transferred, gifted, withdrawn, or exchanged for any other currency or form of value.
  4. Refunds: You may request a refund within 30 days after payment. Credits that have not been consumed can be refunded if requested within 30 days of purchase. Credits that have already been consumed correspond to services that have been delivered (for example, application creation, code generation, and other creative or programming services) and are not refundable. If part of a purchase has been consumed, the refund is not made in full; it is calculated in proportion to the credits that remain unconsumed (amount paid × unconsumed credits ÷ credits purchased). To request a refund, email support@appproduce.com with your account email and order number. Approved refunds are returned to the original payment method.
  5. Price adjustment: Given changes in the market environment and business strategy, Huijian reserves the right to charge for currently free services and adjust prices in the future. This does not require your prior consent, but an announcement will be made before the adjustment.
  6. Service changes and termination: For technical upgrades or to comply with national policy, Huijian may add, delete, replace, or adjust service content. Except in statutory or agreed circumstances, Huijian has the right to terminate some services with prior notice. The service term terminates early upon any of the following:
    • Termination by mutual agreement;
    • You lose eligibility to use the service or actively apply for deactivation;
    • You violate laws and regulations, this Agreement, or other management rules of Huijian;
    • Other circumstances requiring termination under the agreement or by law.
    • Note: Regardless of the reason for suspension or termination, the obligations you should perform and the responsibilities you should bear before termination are not affected.

III. Intellectual Property and Data Ownership

  1. Ownership of generated content: The ownership of original content you generate using this platform's tools belongs to you, and Huijian makes no claim to it. However, you understand and agree that, due to the nature of the AI generation mechanism, Huijian may generate similar or identical content for other users, and Huijian retains the relevant rights to such generated content.
  2. Payment and confirmation of rights: Although you own the generated content, before you settle all related fees (including but not limited to generation compute fees, source code download fees, and server resource usage fees), you may be unable to exercise full ownership rights (such as commercial licensing or source code export).
  3. Responsibility for compliant use: You must judge the legality of the generated content yourself and ensure it does not infringe the rights of third parties. Huijian assumes no obligation to review or guarantee your generated content. You bear all legal consequences of using the content for commercial publication or sharing it with others.

IV. User Rights and Obligations

  1. Authorized use of data: To optimize the service experience and promote the product, you authorize Huijian to process your data within the following scope:
    • Perform necessary technical analysis and processing on the materials you upload (images, documents, code, etc.) and display the results within the platform;
    • Allow Huijian to use works you generate using the service (de-identified or with your consent) for the platform's case displays, marketing, and promotional reporting.
    • This authorization remains effective during the term of the Agreement and after its termination, and is a non-exclusive, royalty-free authorization.
  2. Legal and compliance commitment: You promise to strictly comply with Chinese laws and regulations and not use this platform to create, copy, publish, or disseminate the following information that disrupts the platform's normal operation or infringes the rights of others:
    • Opposing the basic principles established by the Constitution;
    • Endangering national security, leaking state secrets, subverting state power, or undermining national unity;
    • Damaging national honor and interests;
    • Distorting, defaming, desecrating, or denying the deeds and spirit of heroes and martyrs, or infringing the name, likeness, reputation, or honor of heroes and martyrs by insult, slander, or other means;
    • Promoting terrorism or extremism, or inciting terrorist or extremist activities;
    • Inciting ethnic hatred or discrimination, or undermining ethnic unity;
    • Undermining national religious policy, promoting cults or feudal superstition;
    • Spreading rumors, disrupting economic and social order;
    • Spreading obscenity, pornography, gambling, violence, murder, terror, or abetting crime;
    • Insulting or slandering others, or infringing others' reputation, privacy, or other legitimate rights;
    • Containing other content prohibited by laws and administrative regulations.
  3. Prohibition of abuse: You may not use this service for illegal purposes, may not interfere with the normal operation of the platform's servers, and may not reverse-engineer, crack, or attempt unauthorized access to this system.
  4. Handling of breaches: If you violate the above commitments, Huijian has the right, without notice, to take measures including but not limited to deleting content, suspending service, and banning accounts. If this causes losses to Huijian or third parties, you shall bear full liability for damages (including direct losses, loss of expected benefits, and reasonable attorney and litigation fees).

V. Disclaimer

  1. Service status: This service is provided on an "as is" and "as available" basis. Huijian strives to provide a stable and accurate service but makes no express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or uninterrupted service.
  2. Force majeure: Huijian bears no liability for compensation for service interruption or data loss caused by factors beyond Huijian's subjective control, such as telecommunication failures, network congestion, hacker attacks, power outages, natural disasters, government controls, or failures of your own equipment.
  3. Content disclaimer: Content generated by this platform is for reference only and does not constitute professional advice. Huijian is not responsible for the accuracy or completeness of the generated content. No commissioned-creation or employment relationship is formed between you and Huijian, and you shall independently be responsible for the results of use.
  4. Qualification review: If you operate products generated with this platform for the public, you must obtain the required ICP filing, public security network filing, and other administrative permits yourself. Huijian bears no joint liability arising from your lack of qualifications.

VI. Confidentiality

Both parties have a strict obligation to keep confidential the other party's trade secrets (including but not limited to technical solutions, customer lists, and financial data) learned during cooperation. Without the other party's written consent, neither party may disclose them to third parties or use them for purposes other than performing this Agreement.

VII. Dispute Resolution

  1. The validity, interpretation, and dispute resolution of this Agreement are governed by the laws of the People's Republic of China.
  2. If any dispute arises between you and Huijian, it should first be resolved through friendly negotiation; if negotiation fails, either party has the right to file a lawsuit with the competent people's court at the plaintiff's place of domicile.
